On April 26, 2012, I posted a blog entry entitled "
Arkansas May Roll Dice With Gaming Ballot Referendum" that
pointed out a clerical error which could have caused a major issue
regarding a proposed ballot initiative to amend the Arkansas
Constitution to open Arkansas up to establish four casino gaming
The Arkansas Attorney General Dustin McDaniel has now issued a
new opinion, Opinion No. 2012-064, which cured the error.
According to the Attorney General's opinion, the
re-certification was necessary "[d]ue to the omission in [the
applicant's] submitted ballot title of one item set forth in
your measure relating to the distribution of casino gaming tax

the error stating that "Attorney General Dustin McDaniel
issued an amended opinion today after a private attorney in New
Jersey spotted an error in an opinion McDaniel issued earlier in
the week certifying a proposed gambling amendment."
The original certification mistakenly omitted the Arkansas
Children's Hospital as a proposed recipient of 8 percent of a
special casino tax to be implemented if the ballot measure is
